Ontario registrar orders Diocese of Kingston cemetery operator to stop selling licensed supplies and services
Why this matters
A stop-sale with an exit: the order is tied to the non-compliance the registrar cites and runs until the operator corrects it and reports back, and it leaves room for existing customers' contracts to be honoured.
The registrar under Ontario’s Funeral, Burial and Cremation Services Act, 2002 has ordered the operator, named in the notice as R.C.E.C. of the Diocese of Kingston in Canada and licensed as a cemetery operator in Kingston, to stop selling and offering to sell licensed supplies and services. The order was set out in a September 25 notice published by the Bereavement Authority of Ontario.
The registrar says the operator is in breach of the Act for failing to meet reporting obligations under section 109 of Ontario Regulation 30/11, and for failing to comply with a registrar’s order for information under section 111 of the Act. The cease-sales order itself was made under subsection 109(7) of the regulation.
Consumers who prepaid for services, or held existing interment rights, before the order took effect may still be provided the services they contracted. The order stays in force until the operator corrects the non-compliance and tells the registrar that it has.
The notice does not say what the operator filed or failed to file, or whether the order can be appealed.
